Do I have to pay maintenance money to my ex-partner?

Usually, you do not pay alimony to your ex-partner, but this is not always the case. Under certain circumstances, however, you are obliged to pay alimony to your ex-partner.

After a divorce, you may be required to pay maintenance to your ex-spouse under certain conditions.

  • If you are divorced on grounds of irreparable dislocation, then in principle and within certain limits, you must pay alimony to your ex-spouse if he or she is indigent and has not been found guilty of partner violence or other serious misconduct, e.g. proven adultery.
  • If you are divorced by mutual consent, you must pay alimony only to the extent agreed in the agreement with your ex-spouse.

After the termination of a de facto cohabitation or legal cohabitation, you are not obliged by law to pay alimony to your ex-spouse, even if he or she is indigent.

Do I need a lawyer?

A lawyer can guide you through this complex process from his knowledge and experience. Consult them as soon as possible so that you do not rush into any agreements and your interests are best defended in court.
